DE Innovations Inc. (referred to herein as “Drunk Engineers”, “we”, “us” and “our”) respects your privacy and is committed to protecting the privacy of those who access our website at www.drunkengineers.ca (the “Website”). 

This privacy policy (“Privacy Policy”) describes and governs how we collect personal information in connection with your use of the Website and how we use and share that personal information, Please take time to read this Privacy Policy carefully.

By continuing to use the Website, or otherwise providing us with your personal information, you are accepting this Privacy Policy in its entirety and without modification and consenting to our collection, use and sharing of the personal information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please discontinue accessing and using the Website immediately and do not otherwise provide us with your personal information.

We reserve the right to revise or modify this Privacy Policy periodically. We will notify you of any changes by indicating at the bottom of this page the date this Privacy Policy was last changed, so that you are always informed about what personal information we collect, how we use it and under what circumstances we may disclose it. Your continued access to and use of the Website or your purchase of goods from Drunk Engineers through the Website after any such changes constitutes your acceptance of, and agreement to be legally bound by this Privacy Policy, as revised. Please periodically review this Privacy Policy so that you know what personal information we collect, how we use it and with whom we may share it.

This Privacy Policy is incorporated into and forms part of the Terms of Service for the Website.

  1. What information does Drunk Engineers collect?

We collect information from you only when you choose to provide information to us (such as by purchasing our products), when you voluntarily provide it through the Website, or when you provide it to us through other means. The information we collect depends on how you use the Website or otherwise communicate or interact with us.

Personal Information

Personal information means information about an identifiable individual (e.g. name, address, telephone number, e-mail address, payment information) but, to the extent permitted by the law, does not include the contact information of an employee of an organization. Personal information does not include anonymous or non-personal information (i.e. information that cannot be associated with or traced to a specific individual or anonymized data).

We collect personal information that you knowingly provide when you use the Website. For example, when you place an order for our products through the Website, we need to know personal information such as your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number to enable us to process and fulfill your order and contact you if we have any questions. If you create a personalized account with Drunk Engineers by registering for one on the Website, you will be required to provide us with similar personal information. You may provide us with preferences such as products you may be interested in. In any case, we’ll use the personal information you provided to us to make your shopping more efficient and better serve your interests. 

Now and then, we may conduct survey, contests, mailings or other promotions. If you choose to participate in one of our surveys, contests, mailings or other promotions, we may request personal information, such as your name, e-mail address, telephone number, shopping habits, interests and other personal information, to enable us to execute the promotion and notify winners. Some of this information will be mandatory to participate in the promotion; other information will be optional. We will tell you whether any personal information is mandatory or optional. 

When you send us a request, we may ask you to identify yourself by name or e-mail address in order to send you a response, if appropriate.

Information Sent to Us by Your Provider

Most of the information we collect from you at the Website does not personally identify you to us, although it may be unique or consist of information that you consider personal. For example, we collect information that is sent to us automatically by your Web browser or by using cookies, pixel tags, web beacons, and other Web technologies. This information typically includes your IP address, the identity of your service provider, the name and version of your operating system, the name and version of your browser, the date and time of your visit, the pages you visit and any search terms you enter while on the Website. This information cannot be used to identify you personally unless you identify yourself to us by, for example, making a purchase, creating an account or by giving us your e-mail address. If you provide us with personal information by creating a Drunker Engineers account or otherwise, we may link the information sent to us by your browser to the personal information you have provided to us.

We use “cookies,” “log files,” “web beacons” and other Web technologies for a number of purposes, including:

  • To collect information about the ways you use the Website – for example, which pages you visit, which links you use, and how long you stay on each page;

  • To support the features and functionality of the Website. For example, to save you the trouble of re-entering information already in our database, or to prompt the settings you established on previous visits to the Website; and

  • To personalize your experience when you use the Website.

Generally, the information we collect using these Web technologies does not identify you personally. If, however, you have provided us with personal information by creating an account on the Website or otherwise, we may link the information collected using these Web technologies to the personal information you have provided to us.

When you access this Website by clicking on a link in an electronic communication you receive from us, your browser tells us that someone has clicked on a particular link in that particular communication. We use this information to improve our marketing efforts. 

Social Media/Integration with Third Party Platforms

The Website may permit you to interact with a third-party website or service, such as enabling you to "like" us on another website or "share" content from the Website with third party websites (a "Social Networking Service"). If you choose to "like" or "share" content or to otherwise post personal information from or via the Website to a Social Networking Service, that information may be publicly displayed, and the third party may have access to certain information about you and your use of the Website. In addition, we may receive information about you if other users of a third party website give us access to their profiles and you are one of their "connections" or information about you is otherwise accessible through your "connections" web page, profile page, or similar page on a social networking or other third party website or interactive service. 

The information collected and stored by the third party remains subject to the third party's privacy practices, including, but not limited to, whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third party website and service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature, but we may retain the information previously collected.

Analytics

Portions of the Website may use analytical tools (collectively, “Analytical Tools”) that are operated by use and third party providers, such as Google, Inc, which may use cookies, web beacons, scripts and similar means for the purpose of collecting information and analyzing how your use the Website. Information collected using Analytical Tools will be transmitted and stored on servers located outside of British Columbia, specifically in the United States. The third-party providers of Analytical Tools may also transfer this information to other third parties (such as governmental authorities) where they are required to do so by law, or where such third parties process the information on their behalf. As some Analytical Tools rely on cookies to perform their functions, you can avoid having your usage data collected by those Analytical Tools by disabling cookies in your browser.

  1. How does Drunk Engineers use the Personal Information it Collects?

The personal information we collect may be used by us for the purposes for which it was collected, as provided in this Privacy Policy, or for other purposes that are disclosed to you and to which you consent. For example, when you place an online order with us, we use your personal information to process and fulfill your order. We may send you an e-mail to confirm or to update you on the status of your order. We may also need to contact you by regular mail, e-mail or phone if we have any questions about your order. We may also use your personal information to respond to any of your customer service inquiries. 

We use your personal information to operate and improve the Website and to deliver the products and services you have requested. We keep track of the pages you visit and the manner in which you use the Website to determine what products are most popular and whether to make changes to the Website. Also, we may, from time to time, review your personal information and information of other customers to help us analyze trends, purchasing patterns and preferences, and demographics.

We may also use the personal information you provide to us to personalize your shopping experience by using your product interests, shopping patterns and purchase information to recommend other products, services or promotions that we believe you may be interested in. We may also notify you of changes to the Website. 

We may further use your personal information to:

  • administer a contest, promotion, survey or other Website features;

  • supply you with requested information regarding products available on the Website;

  • send you informational or promotional communications that you have agreed to receive. Visitors who register or participate in other Website features such as marketing programs will be given a choice whether they would like to be on our e-mail list and receive e-mail communications from us.

  • carry out any other purpose permitted or required by law.

By subscribing to Drunk Engineers text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed, and that the messages may be sent via automatic telephone dialling system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to opt-out and HELP for customer support. You may receive an additional text message confirming your decision to opt-out.  You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above is not a reasonable means of opting out.

  1. Does Drunk Engineers Share Your Information with Third Parties?

We may share your personal information with our trusted third-party service providers to help us manage and operate the Website, process your orders, perform statistical analysis, send you e-mail, postal mail or text messages, provide customer support and perform other important services. Although these partners may not be affiliated with us, they are required to maintain the confidentiality of your personal information and are not authorized to discuss, disclose or make any use of your personal information except as necessary to provide such services. We may use service providers located outside of Canada, and, if applicable, your personal information may be processed and stored in other countries and therefore may be subject to disclosure under the lows of those countries. Please note that Third Party Sites may collect and treat information collected differently, so we encourage you to review the privacy policies of such Third Party Sites so that you understand how those websites collect, use and share your information.

We use Shopify Inc. (“Shopify”) to power our online store. When you purchase our product through Shopify, you provide the personal and financial information needed to process your application or purchase directly to Shopify and other companies associated with your purchase such as PayPal Holdings, Inc. The companies that administer these programs are independent of Drunk Engineers and have their own privacy policies. We strongly encourage you to review the privacy policies of Shopify, which you can find here: https://www.shopify.com/legal/privacy

Unless you have given us your permission to do so, we will not share your personal information with unaffiliated third parties for the purpose of enabling those third parties to offer you products or services or otherwise market or promote to you. Further, unless you have given us your permission to do so, we will not share any personal information with any affiliates of Drunk Engineers. However, we may partner with third parties to help us collect and aggregate certain information collected at the Website. We may share this aggregated, non-personal information with existing and prospective business partners and advertisers. None of the aggregate information will contain any information that identifies you individually. 

We and our third party service providers may disclose specific personal information if we or they reasonably believe that it is necessary to: (i) investigate any suspected misuse of the Website; (ii) comply with applicable federal, provincial or municipal laws, rules, regulations or orders; (iii) to protect or defend the rights, property and interests of Drunk Engineers, our customers, or the interests of our third party service providers; or (iv) under exigent circumstances, to protect the personal safety of users of the Website of the public. We will only disclose personal information to government agencies for the purpose of complying with a subpoena, warrant or order issued or made by a court, person or body with jurisdiction to compel the production of personal information.

Your personal information may be transferred to another entity that succeeds to all or part of our business in connection with a sale, reorganization, consolidation or merger. You are deemed to consent to disclosure of your personal information for those purposes.

Please note that we do not alter our Website’s data collection and use practices when we see a Do Not Track signal from your browser. 

  1. Your Rights

If you are a European resident, you have the right to access Personal Information we hold about you and to ask that your Personal Information be corrected, updated, or deleted. If you would like to exercise this right, please contact us via the points of contact listed at the end of this Privacy Policy. 

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Website), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. 

  1. Retention of Personal Information

Personal information collected in any form will only be retained by us so long as it is necessary: a) for the purposes for which it was collected; b) to be retained by law; c) to address any issues that may arise at a later date. The length of time we retain personal information varies, depending on the nature of the information. The retention period may extend beyond your relationship with us. When your personal information is no longer required for our purposes, the information is either physically destroyed or deleted.

  1. How Can You Unsubscribe or Change Your Information?

We want to communicate with you only if you want to hear from us. If you have provided us with your personal information, but later decide you no longer want us to send you any commercial information, you may unsubscribe by using the unsubscribe message in any of our commercial electronic communications. To unsubscribe from an e-mail list, please follow the instructions in any e-mail you receive.

If you would like to update or change your personal information or preferences, or if you would like to have it removed or corrected, please send your request to us via the points of contact listed at the end of this Privacy Policy. Please provide your full name, company name, address, and e-mail address so that we can locate you. We will respond to your request within a reasonable period of time and we will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your personal information. If you have an account with us for the Website, you may update or change your personal information or preferences through such online account.

  1. What Security Measures Does Drunk Engineers use to Protect Your Information?

We take care to provide a level of security appropriate to the sensitivity of the personal information we collect and maintain. We protect your personal information by maintaining physical, organizational and technological safeguards (appropriate to the sensitivity of such personal information) and designed to help protect against unauthorized use, disclosure or access.

Although we use reasonable and prudent measures to protect out Website, computer systems and any personal information that we have collected from unauthorized access, use, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection. As a result, we cannot guarantee the security of information provided over the Internet or stored in our databases. Your transmissions are, therefore, at your own risk.

Not all of the pages on the Website are secure. Most of the pages on our Website provide information to you about Drunk Engineers and our products and do not allow you to provide us with personal information. As a result, these pages are not secured using encryption or other technology. We do, however, use industry standard technologies to secure all pages that allow you to provide us with personal information and/or purchase our products. You may use your browser tools to identify whether any particular webpage is “secure” or not.

Personal information we collect is stored and processed on servers located in Canada.

  1. Minors

Access to and use of the Website is made available only to people who can form legally binding agreements under applicable law. The Website is intended for a general audience and is not intended to be used by children under the age of majority in their jurisdiction of residence. Drunk Engineers does not knowingly collect personal information from the children under the age of majority in their jurisdiction of residence. Children accessing the Website should obtain the permission and assistance of a parent or legal guardian. If a child has already provided us with personal information, his or her parent of guardian may contact us for the purpose of deleting this information.
